How to Register Your Copyright Online: A Simple Step-by-Step Guide

Written by
  1. Introduction to Copyright Registration –

Copyright registration is a legal process that provides protection to creators of original works, such as literature, music, art, software, and films. By registering a copyright, you secure exclusive rights over the use, reproduction, and distribution of your work, ensuring that others cannot exploit it without your permission. It serves as official proof of ownership, making it easier to enforce your rights in case of infringement or disputes.

2. What Can Be Copyrighted?

In India, copyright law, governed by the Copyright Act, 1957, protects original works across various categories. Copyright provides the creator with exclusive rights to use, reproduce, and distribute their work. The following types of works are eligible for copyright protection –

  1. Literary Works — Books, articles, essays, poems, novels, technical papers, computer software, and more.
  2. Dramatic Works — Plays, scripts, screenplays, choreographed performances, and more
  3. Musical Works — Sheet music, musical notations, compositions, melodies
  4. Artistic Works — Paintings, drawings, sketches, sculptures, architectural works, photographs, and digital artwork
  5. Computer Software — Operating systems, applications, games, and digital tools

3. Benefits of Registering Your Copyright –

  1. Copyright registration serves as official proof that you are the owner of the work. This can be crucial in legal disputes.
  2. By registering your copyright, you secure exclusive rights over how the work is used.
  3. If you plan to monetize your work through licensing, publishing, or selling, having a registered copyright makes the process smoother and more credible.
  4. Registered copyright holders are entitled to statutory damages in the event of infringement.

4. Documents Required for Copyright Registration –

  1. 2 copies of work
  2. If the applicant is not the author, an NOC from the author is required, granting permission to register the copyright in the applicant’s name
  3. If the work involves multiple creators or co-authors, an NOC from all the co-authors or other copyright owners must be submitted
  4. If someone is filing the copyright application on behalf of the author or owner, a Power of Attorney (PoA) document must be provided
  5. Identity and address proof of the applicant
  6. If the applicant is a company or legal entity, a Certificate of Incorporation or other proof of legal existence is required to show that the company owns the copyright
  7. For films or cinematographic works, if any external producers, directors, or contributors are involved, a formal authorization letter must be provided
  8. Proof of payment of the copyright registration fees
